Policies and Helpful Information

  • Administrative/Preparation Fees:

    • For a half-day civil mediation, the parties will be charged an administrative fee of $125 per party, in addition to the professional fee, regardless of whether the mediation is conducted in person or via Zoom (totaling $250).

    • For a full-day in-person civil mediation, the parties will be charged an administrative fee of $175 per party, in addition to the professional fee (totaling $350).

    • For a full-day Zoom civil mediation, the parties will be charged an administrative fee of $150 per party, in addition to the professional fee (totaling $300).

    • No administrative fee is charged for domestic mediation unless lunch is provided, in which case the fee is $100.00.

  • Multi-Party Mediation: In cases involving more than two “sides,” $500 will be added per additional side for a 1/2-day mediation, and $ 1,000 will be added per additional side for a full-day mediation.

  • Over time: If the mediation runs over the scheduled time, the “overtime” will be billed at the rate of $375/hr for one mediator and $450/hr if there is a co-mediator present. If the mediation exceeds the scheduled time in a multiparty mediation, an additional $50/hr shall be added to the overtime rate for each additional party beyond two for a single mediator, and an additional $75/hr shall be added for each additional party beyond two for a co-mediation.

  • Travel Time, Mileage, and Overnight: Niblock Mediation Services does not charge for travel time or mileage within the state of Arkansas. However, if an overnight stay is necessary, an additional charge equal to half of the mediation professional fee will be added per mediator, to be split by the parties.

  • Responsibility for Payment: Each party’s attorneys and their respective clients shall be responsible for the timely payment of all fees and costs accrued.

  • When Fee is Earned: Any fees shall be considered “earned” upon the commencement of mediation.

  • Mediation Statements: It is up to each party or their attorney to submit a confidential mediation statement. While not mandatory, a thoughtful mediation statement that encapsulates the key issues involved can be beneficial; therefore, we at Niblock Mediation Services encourage sending a mediation statement in advance of the mediation.

  • Co-Mediation: In some instances, the parties and their lawyers may opt to have a co-mediator assist. Co-mediators can be helpful when they bring a specific skill set or expertise to the mediation that bears on the issues the parties need help resolving.
